This One Year Warranty is a part of the Construction Contract “Contract”) dated __________________ between (“Builder”) Heller Homes and (“Homeowner”) ______________________________________.

- Warranty. Builder warrants that the residence located at ___________________ shall be free from defects in materials and workmanship on non-structure items for a period of on (1) year following the Warranty commencement date and shall be free form defects with respect to structural items for a period of ten (10) years following the Warranty commencement date.

In making a determination whether an item or problem is considered to be a defect, the parties agree to follow the guidelines set forth in the Indiana Quality Assurance Builders standards Book. Homeowner understands and agrees that the booklet will explain certain standards for the residential building industry and whether an item or problem rises to the level of being a defect.

- Warranty Commencement Date. The Warranty commencement date shall be ________________ or the date on which Homeowner took possession of the residence, whichever shall occur first.

- Exclusion. The following items are excluded from this Warranty:
- Defects in appliances and equipment that are covered by manufacturer’s warranties.
- Damage due to wear and tear, abusive use, misuse, or lack of proper maintenance.
- Defects in items installed by Homeowner or anyone else except Builder and Builder’s subcontractors.
- Loss or injury due to the elements provided Builder is not at fault.

- Dispute Resolution. If a dispute between the parties arises as to whether Homeowners is entitled to the benefits of this Warranty, the matter shall be resolved through a binding arbitration submitted through the Better Business Bureau of Northern Indiana.

Acknowledgment of Homeowner. Once the Warranty period has expired, Homeowner shall assume complete responsibility and liability for any and all repairs associated with the residence except for any manufacturer’s warranties. |
